Apollo Sunshine - a true story of true music

Psychedelic rock serves variously as a baseline and a horizon for this Massachusetts band, which absorbs the weirder 1960s pop conventions into an earnest mannerism. "Shall Noise Upon" (Headless Heroes), Apollo Sunshine's third album, revels in the trappings of a time-stamped delirium: echo-trippy vocals, analog keyboards, British accents, fuzz-tone guitars. There are lyrics about vibrations, love, reincarnation and currency. One song is called "Green Green Lawns of Outer Space." What keeps the whole enterprise from slipping into camp (most of the time, anyway) is the care exhibited by the musicians, especially Apollo Sunshine's core members, Jeremy Black, Sam Cohen and Jesse Gallagher. Playing many different instruments, sometimes switching off to one another, they forge a slippery continuity out of messy glory. Sometimes they also manage beauty.

This was taken from the New York Times write-up about the guys. I have never heard anything that rivals the sounds these three produce. I had a chance to work several times with Apollo Sunshine, and I can attest to their good nature.

And how much more incentive do you need other than knowing someone is good natured to make a decision to check out their songs?

Do yourself a favor and let yourself into one of their live shows. Kiss yourself.

So I was reading the Wall Street Journal this morning and came on an article about two sisters engaged in a lawsuit about ownership of copyright in a book. The one sister wrote the book and the second sister claimed that she was a joint author. The second sister doesn't claim that she contributed large parts to the book, just that she made suggested minor improvements.

What exactly does this mean to the first sister? Well, she could have to share any profits from the book divided down the middle. That is not a big problem when you make $2 from a friendship bracelet that you took turns weaving while cooking grilled cheese sandwiches by the side of a muddy path at a hippie fest. Now you each have $1 to put towards breath mints or a cheap hit of acid. Everybody is better off and no one lost out on the fruits of his or her own labor. The issue of someone claiming to be a joint author becomes significant when you get a publishing deal.

Now lets say that instead of a friendship bracelet woven tag-team style, one of you spent three months writing a song and then your brother downloaded a copy and claimed he worked on it too. Do you have to share 50% of the royalties? Well, 1. no one makes money off of recordings anymore, you have to tour, 2. the record companies would have had you sign away your publishing rights when you "got signed", and 3. hell no, you fight this.

So who owns the copyright. Well, that depends on a few things. First, does copyright subsist in the work? This means is it something that can be copyrighted. §102 of the Copyright Act states that "copyright subsists in any original work of authorship that is fixed in a tangible medium of expression." If this is an original work and it is recorded or written down then copyright subsists. Nothing has to be filed with the government, it is copyrighted.

Second, who actually owns that copyright? The original author or authors owns the copyright. But does this just come down to he said/he said? As long as you did not intend for any input or contributions to be merged into inseparable or interdependent parts of the whole, then you may be the sole owner. Some cases have held that it comes down to what the dominant author intended.

The lesson is to be careful when working with others if you want to protect your copyright. Make sure that it is clear that you don't intend for the guy yelling "edible applicators" in the background over your beat to have his contribution merged into the whole and be considered a joint author and owner of the copyright.

Talk to a lawyer. Really. This doesn't have to be that expensive and intellectual property should be protected just as carefully as physical property.
